1. Acceptance of Terms
Welcome to PerfectFIT. These Terms and Conditions govern your access to and use of the PerfectFIT website, mobile application and related services (the "Platform").
By creating an account, browsing the Platform, booking a class or making payment through PerfectFIT, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.
2. About PerfectFIT
PerfectFIT is a digital platform that connects users with independent fitness, wellness and movement studios and allows users to discover, book and attend classes through one platform. PerfectFIT acts as a digital booking marketplace and technology facilitator between users and partner studios.
PerfectFIT responsibilities
PerfectFIT is responsible for:
- maintaining and operating the Platform;
- processing bookings and payments through the Platform;
- issuing booking confirmations;
- managing user wallets and credit balances;
- facilitating communication related to bookings between users and studios;
- supporting users with booking-related platform enquiries.
PerfectFIT does not directly provide fitness instruction or operate studios.
User responsibilities
By using PerfectFIT, users agree to:
- provide accurate registration and payment information;
- arrive on time for booked classes;
- follow studio rules, safety instructions and class etiquette;
- ensure they are medically fit to participate;
- use the Platform lawfully and respectfully;
- maintain the confidentiality of their account login details.
Users participate in classes voluntarily and at their own risk.
Studio responsibilities
Partner studios are responsible for:
- delivering the booked class or service at the scheduled date and time;
- maintaining a safe and suitable training environment;
- providing qualified instructors where applicable;
- ensuring class schedules listed on PerfectFIT remain accurate;
- communicating any schedule changes or cancellations to PerfectFIT promptly;
- complying with all applicable health, safety and legal requirements relevant to their business.
Studios remain fully responsible for the in-person delivery of their services.
3. Eligibility
You must be at least 18 years old to create an account or make bookings through PerfectFIT. By using the Platform, you confirm that:
- you are legally able to enter binding agreements;
- your information is accurate and complete;
- you are authorised to use the payment method submitted.
4. User Accounts
To access certain services, users may be required to register an account. You agree to:
- keep your login credentials secure;
- keep your information updated;
- accept responsibility for activity under your account.
PerfectFIT may suspend or terminate accounts involved in misuse, fraud or breaches of these Terms.
5. Bookings and Attendance
Bookings made through PerfectFIT reserve a space in a class offered by a participating partner studio. All bookings are subject to availability at the time of confirmation.
Upon successful booking:
- payment is processed via the Platform;
- confirmation is issued digitally;
- the user attends the selected class at the selected studio.
Users are responsible for arriving on time. Late arrival may result in refusal of entry where entry would disrupt the class or where the class has already started.
Studios may reschedule or cancel classes where reasonably necessary. Where this happens, users will be notified through the Platform.
6. Payments, Credits and Wallet Balance
All prices displayed on PerfectFIT are listed in credits. 1 PerfectFIT credit = 1 South African Rand (ZAR 1). Users book classes using credits held in their PerfectFIT wallet.
How the wallet works
- Users top up their PerfectFIT wallet by purchasing credits through the Platform. (Minimum purchase amount required is ZAR 5.)
- Credits are then used to book classes listed on PerfectFIT.
- Each class will display its booking price in credits.
- The number of credits required for a booking will be deducted from the user's wallet at checkout.
Example: A class listed at 120 credits requires a wallet balance of 120 credits (ZAR 120) to complete the booking. Users may top up their wallet at any time with the number of credits needed for a booking.
PerfectFIT may offer wallet top-ups, promotional credits, vouchers and bonus credit campaigns. Credits in your wallet:
- may only be used toward bookings on the PerfectFIT Platform;
- are non-transferable between users;
- are not redeemable for cash unless required by applicable law;
- may expire where promotional terms specifically state an expiry date.
PerfectFIT reserves the right to correct pricing errors, incorrect credit values or cancel transactions affected by technical issues.
7. Cancellation and Refund Policy
All cancellations must be made at least 1 hour before the scheduled class start time to qualify for a refund. Where a cancellation is made at least 1 hour before class:
- the booking will be cancelled; and
- the credits used for that booking will be refunded back to the user's PerfectFIT wallet.
Refunds are processed in credits only. PerfectFIT does not issue refunds back to bank cards, bank accounts or original payment methods unless required by applicable law. Because 1 credit = ZAR 1, refunded credits retain the same wallet value and may be used toward future bookings on the Platform.
Cancellations made less than 1 hour before class start time may be treated as late cancellations and may not qualify for a refund. No-shows are non-refundable. Refunded wallet credits remain available in the user's wallet for future bookings through PerfectFIT.
To protect studios against repeated last-minute changes, users may cancel a maximum of 3 bookings per calendar week (Monday to Sunday). Once this limit is reached, no further bookings may be cancelled until the following week.
8. Fulfilment of Services
PerfectFIT's fulfilment process is fully digital and service-based. The process works as follows:
- A customer books and pays online through the PerfectFIT Platform.
- The booking is confirmed digitally within the Platform.
- The customer receives booking confirmation electronically.
- The customer attends the selected class at the chosen partner studio.
- The partner studio delivers the booked class or service directly at the booked date and time.
No physical goods are shipped through PerfectFIT. All fulfilment takes place through digital booking confirmation and in-person attendance at the selected studio.
9. Health and Participation
Fitness and wellness activities involve physical exertion and inherent risk. By attending any class booked through PerfectFIT, you confirm that:
- you are medically fit to participate;
- you understand the physical demands of the activity;
- participation is voluntary;
- you participate at your own risk.
You should consult a healthcare professional before starting any new exercise programme where appropriate. PerfectFIT is not responsible for injury, illness, physical loss or damage arising from participation in any class booked through the Platform.
10. Intellectual Property
All rights relating to the PerfectFIT Platform — including branding, trademarks, logos, software, content, graphics, designs, user interface and technology — remain the exclusive property of PerfectFIT or its licensors. Users may not copy, reproduce, distribute, reverse engineer or commercially exploit any part of the Platform without written permission.
Studios and users retain ownership of content they upload but grant PerfectFIT a licence to host, display and use such content for operating and promoting the Platform.
11. Disclaimer and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. PerfectFIT makes no guarantee that the Platform will always be uninterrupted, that all listings will always be error-free, or that services will always be available at every studio.
To the fullest extent permitted by law, PerfectFIT is not liable for:
- injury sustained during participation;
- loss or damage at studio premises;
- acts or omissions of studios or instructors;
- class cancellations or schedule changes;
- indirect or consequential loss.
PerfectFIT's total liability for direct damages is limited to the greater of the amount paid by you to PerfectFIT in the preceding 12 months or ZAR 1,000, except where liability cannot be excluded under applicable law.
12. Privacy and POPIA
PerfectFIT processes personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA"). By using the Platform, you consent to the collection, use and processing of your personal information as described in our Privacy notice. Information may be shared with partner studios where required to fulfil bookings. Access to certain records may also be governed by the Promotion of Access to Information Act ("PAIA").
13. Suspension or Termination
PerfectFIT may suspend or terminate access to the Platform if a user:
- breaches these Terms;
- behaves abusively toward studios or staff;
- misuses the Platform;
- engages in fraudulent activity;
- interferes with operation of the Platform.
14. Changes to Terms
PerfectFIT may update these Terms from time to time. Updated Terms will be published on the Platform with the revised effective date. Continued use of the Platform after changes become effective constitutes acceptance of those updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes relating to use of the Platform will first be addressed in good faith between the parties. Where unresolved, disputes may be referred to mediation, arbitration or the courts of South Africa in accordance with applicable law.
